Terms of website use

This page (together with the documents referred to on it) tells you the terms of use on which you may make use of my website www.vote4toptunes.com (“my site”), whether as a guest or a registered user. Please read these terms of use carefully before you start to use the site. By using my site, you indicate that you accept these terms of use and that you agree to abide by them. 1. Information about ME

1.1. www.vote4toptunes.com is a site operated by Vote 4 Top Tunes. Main trading address is, Benahavis, Andalucia, Spain.

2.1. Access to the site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on my site without notice (see below). I will not be liable if for any reason my site is unavailable at any time or for any period.

3.1. We hold or have no rights whatsoever to music uploaded by talent and/or personal information given by users.

3.2. We specify catagorically any talent uploading music to the site that it has been copy written by the talent.

3.3. You may print off one copy, and may download extracts, of any page(s) from my site for your personal non-commercial use and you may draw the attention of others to material posted on my site. Any other use requires express written approval from the user or talent via this site.

3.4. Except as permitted under these terms of use you must not, and you must not assist any other person to, copy, lend, hire, reproduce, sub-licence, republish, disassemble, decompile, reverse engineer, download, post, broadcast, transmit, make available to the public or, otherwise abuse any of the content on the site in any way.

3.5. You must not adapt, alter or create a derivate work from any content on the site.

3.6. The status (and that of any identified contributors) as the authors of material on my site must always be acknowledged and protected.

3.7. You must not use any part of the materials on my site for commercial purposes without obtaining permission to do so from me via the uploader.

7. information about you and your visits to the site

7.1. I process information about you in accordance with my privacy policy. By using my site, you consent to such processing and you warrant that all data provided by you is accurate.

8. Uploading material to my site

8.1. Whenever you make use of a feature that allows you to upload material to my site, or to make contact with other users of my site, you must comply with the content standards set out in my acceptable use policy.. You warrant that any such contribution does comply with those standards.

8.6. I will not be responsible, or liable to any third party, for the content or accuracy of any materials posted by you or any other user of the site.

8.7. I have the right to remove any material or posting you make on the site if, in my opinion, such material does not comply with the content standards set out in my acceptable use policy..

9. Viruses, hacking and other offences

9.1. You must not misuse my site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to my site, the server on which my site is stored or any server, computer or database connected to my site. You must not attack my site via a denial-of-service attack or a distributed denial-of service attack.

9.2. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. I will report any such breach to the relevant law enforcement authorities and I will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use my site will cease immediately.

9.3. I will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of my site or to your downloading of any hazardous material posted on it, or on any website linked to it.

We will take every precaution to defend the site against such happenings coupled with the proper defences of the users and talent.

10.1. You may link to my home page, provided you do so in a way that is fair and legal and does not damage the sites reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on my part where none exists.

10.2. You must not establish a link from any website that is not owned by you unless you have the website owner’s permission to establish a link.

10.3. I reserve the right to withdraw linking permission without notice. The website from which you are linking must comply in all respects with the content standards set out in my acceptable use policy..

11. Links from my site;

Where my site contains links to other sites and resources provided by third parties, these links are provided for your information only. I have no control over the contents. Should the contents be deemed unsuitable, we will remove accordingly. Advertisers should be compatible with the Advertising Rules and Regulation. We will not accept responsibility for them or for any loss or damage that may arise from your use of them.

12. Jurisdiction and applicable law,

The English courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to my site although I retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country. These terms of use are governed by English law.

13. Third party rights;

Apart from the exclusion of liability to third parties connected to me as set out at paragraph 6, a person who is not a party to these terms of use shall not have any rights under or in connection with it.

14. Waiver

A failure or delay by you or me to exercise any right or remedy provided under these terms of use or by law shall constitute a waiver of that or any other right or remedy, nor shall it preclude or restrict the further exercise of that or any other right or remedy. 17. We hold no rights, intellectually or otherwise to any songs uploaded by users and/or talent. Notwithstanding we do have the right to delete any songs we deem unfit for public consumption.
